The agreement

By using Paintune you agree to these terms. If you are using it on behalf of a company, you confirm you are authorised to accept them for that company.

Your account

Keep your credentials and API keys to yourself. You are responsible for activity under your account, including anything generated with your keys. Tell us promptly if you think a key has leaked and we will rotate it.

What you may generate

Anything not excluded by the acceptable use policy. We may refuse or block requests that breach it, and repeated or serious breaches end your access.

Who owns the output

You own the images you generate, and you may use them commercially. We claim no ownership over your output. We retain only the rights needed to operate the service — which includes storing your generations so you can retrieve them.

One thing worth knowing that is a matter of law rather than of this agreement: images produced by a generative model may not attract copyright protection in some jurisdictions. If that matters to your use, take your own advice.

Service availability

We aim to keep Paintune available continuously and to give notice before any breaking change to the API. Standard plans are provided without a formal uptime commitment; Enterprise agreements include an SLA with defined targets and remedies.

Fees and billing

• Paid plans are billed on the basis set out at sign-up.
• Overages are billed at the plan rate; we will warn you before you hit them.
• We will give notice before changing prices for an existing plan.
• Refunds are covered by the refund policy.

Liability

To the extent the law allows, our liability arising out of your use of Paintune is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect or consequential loss. Nothing here limits liability that cannot lawfully be limited.

Ending it

You can stop using the service and close your account at any time. We can suspend or end access if these terms or the acceptable use policy are breached. If we end your access without cause, we refund the unused portion of your period.

Governing law

These terms are governed by the laws of India. The courts at Prayagraj, Uttar Pradesh have exclusive jurisdiction over any dispute arising from them, except that either party may seek injunctive relief in any court of competent jurisdiction.
